I was abused and disrespected, sexually assaulted survivor testifies in court

Mbabane- In the still of the night, fear often lurks in the shadows, and for one woman, a seemingly simple walk-about turned into a harrowing experience.

On that particular day, she was an offended complaint who had just been sexually violated.

On Tuesday, the complaint narrated of her encounter with the man she had to again face as a witness at the Mbabane Magistrates Court during the continuation of a trial of a Sexual Offences and Domestic Violence (SODV) Act of 2018 where she is a survivor. 

The survivor’s identity is concealed for ethical reasons.

However, for her mostly that what her friend, Zandi, or anyone can narrate, the events of November 4, 2024, while she was at (or near) Motshane area in the Hhohho region, were traumatic, as the accused person allegedly commit a sexual violation on her by grabbing her hand and making her to hold his penis without her consent.

Accompanied by her friend Zandi, the two were navigating their way home when they encountered a series of unsettling events that would lead to the alleged assault, the effects of which were the forever altered perceptions of safety.

It was already late at night, and as they approached Mpolonjeni, the atmosphere grew tense. Seeking refuge, the two women decided to enter a nearby establishment, hoping to find familiar faces. Their luck seemed to change when they spotted Zandi’s boyfriend, who assured them that a friend’s vehicle would transport them safely to their homes. However, as the journey began, it quickly became clear that not all was as it seemed.

Instead of heading to their intended destination, they found themselves in a vehicle of a stranger. A short while in it, it veered off course. Despite the survivor’s protests, the protagonist felt increasingly trapped as Zandi chose to stay with her boyfriend, leaving her alone with a stranger. When the accused driver, Sandile Mavimbela, confessed he was “running away from the police,” a sense of dread washed over her.

As the car took a gravel road leading into a forest, a chilling realization set in. Attempts to escape were thwarted by locked doors, and her pleas for exiting went unanswered. In a moment of desperation, she said she was coerced into driving the vehicle herself, a skill she had never mastered. This unsettling turn of events revealed the dangerous dynamics at play, as the accused attempted to manipulate the situation further.

When the confrontation escalated, the atmosphere shifted from fear to an outright struggle for autonomy and safety. The man’s intentions became clear, and the woman’s resolve to escape grew stronger. Despite her attempts to negotiate her freedom, she was met with aggression and intimidation, she submitted. 

After managing to escape the forest, she left behind all her belongings, fueled by a primal drive to survive. The driver followed her, pleading for her to return to the car, telling her it was unsafe to walk alone in the dark. His sudden change in demeanor—apologetic and seemingly remorseful—was confusing, but she felt trapped by circumstance.

Upon reaching the Tsela homestead, she noticed her torn clothes from the struggle she was just in and decided to confront the reality of her situation. After a brief moment of contemplation, she returned to the car, only to find him asleep. In a moment of clarity, she resolved to call for help, using one of the cellphones found in the vehicle to retrieve a number which she later forwarded to the police.

Returning home from the ordeal, she hid her clothes and slept on the floor, the weight of the night pressing heavily on her. Before the night was over at around 4:33 AM, she called Zandi and recounted the traumatic events. Zandi suggested she message the accused, asking for an explanation and expressing her expectations for an apology.

Later, Zandi spoke with the accused, only to hear him deny any wrongdoing. By the afternoon, he called again, this time offering money for her belongings and pleading with her not to press charges or inform the mother of his children. This manipulation only highlighted the complexities of the situation, leaving the survivor to grapple with the emotional aftermath.

The events occured during court proceedings. As the story unfolds, it exposes the harsh realities faced by many, urging society to confront and address issues related to consent, safety, and the importance of believing survivors. 

The accused offence has been flagged with a notice that in the event of conviction his particulars will be included in the National Register for Sex Offenders.

The matter is still proceeding in court.
