MBABANE – A dramatic scene unfolded at the High Court in Mbabane today when Pastor Bongi Phiri collapsed moments after being handed a five-year prison sentence without the option of a fine for the sexual assault of an 11-year-old girl.


The sentence was delivered this afternoon, concluding a case that has shocked many in the local community. Phiri was found guilty of the assault, which occurred on October 2, 2024. The court heard that the pastor had kissed the minor on her lips and inappropriately touched her buttocks and thighs.

Phiri was charged under Section 36(1)(a) of the Sexual Offences and Domestic Violence Act (SOVDA) 15/2018. The presiding judge determined that, due to the victim’s age of only 11 years, the mandatory provisions under paragraph (ii) of the Act were applicable, demanding a strict penalty.
The court labeled the crime as profoundly serious. It maintained that children are the most vulnerable members of society and must be shielded from abuse, asserting that sentencing must balance the gravity of the offence, the interests of the community, and the well-being of the victim.

A key point raised was Phiri’s position as a pastor for 20 years. The court stated that his years of spiritual leadership meant he should have had a deep understanding of his moral and social responsibilities. His actions, the court concluded, constituted a significant violation of trust and a failure to uphold basic ethical standards.
In addition to the five-year custodial sentence, the court imposed severe supplementary restrictions. Phiri is permanently barred from operating any business involving the transport of children within the Kingdom of Eswatini. His name will also be entered into the national register of sex offenders.

The judgment, the court noted, is intended to reinforce the judiciary’s firm commitment to protecting minors and to send a powerful message that sexual abuse in the Kingdom will meet with zero tolerance.
