Mbabane – The trial of Sicelo Msibi, Mzwandile Lukhele, Given Mavuso, and Lindani Zitha accused of bombing ATMs and stealing cash took an unusual turn when it adjourned after the accused challenged the Crown on legal grounds.
The three men argued that the Crown was not entitled to parade the lead investigator before court without first availing them with the police report. They backed their demand with Section 90 of the Criminal Procedure and Evidence Act of 1938, which grants them the right to the requested documentation.
Following the objection, the court briefly adjourned after the Crown committed to supplying the report.
The first accused Sicelo Msibi made it clear that if the police fail to provide the document, their evidence will not be used in court. Sicelo Msibi further accused the Crown of attempting to take advantage of their vulnerability, noting that they are South African and currently without legal representation.

The court gave them some time to sort out some to look closely at the police report, they will make their last appearance tomorrow 21. August where a judgement will be issued.
