Lobamba – The Judiciary has strongly condemned statements made in Parliament by Hhukwini Member of Parliament (MP) Alec Lushaba, accusing him of spreading false, misleading, and far-fetched claims against the institution.
In a statement released yesterday, the Judiciary said Lushaba’s remarks were “baseless” and aimed at discrediting the Judiciary for political gains. The statement noted that the MP frequently attacks the Judiciary under the guise of parliamentary immunity, turning the institution into a subject of ridicule.
The Judiciary said Lushaba falsely claimed that it had lied to the public about the progress of the Master’s Commission of Inquiry and that no work was being done. The Judiciary refuted this, saying the Judicial Service Commission (JSC) had completed oral submissions from judicial officers and was finalizing recommendations to be submitted to the Minister of Finance.
Another statement Lushaba purportedly made was that the Judiciary lied about cases being treated differently, dismissing the claim. The Judiciary clarified that all cases are handled in accordance with the constitution, the rules of court, and existing laws, and that every judgment is based on evidence presented in court.
“The cases are allocated to judges and magistrates in accordance with the Rules of Court and dealt with in line with applicable laws,” read the statement. It added that any litigant unsatisfied with a court’s decision has the right to appeal up to the Supreme Court, which is the final court of appeal in Eswatini.
While the Judiciary said it welcomes constructive criticism from Parliament meant to improve public welfare, it accused Lushaba of making “political insults” and pursuing a divisive agenda.
“It is doubtful that the Honourable Member fully understands his mandate in Parliament,” it added.
The Judiciary urged Lushaba to stop his attacks and political grandstanding, saying it would continue using legal means to defend its reputation, including possible contempt proceedings. Lushaba declined to comment on the matter.
