‘MaMkhize’ and ‘Rubber’ disagree over Highlanders’ presidency

MBABANE – The contesting Mbabane Highlanders’ president Bheki ‘Rubber’ Simelane has been told by the club and patrons, in their preliminary points, that he could not have ignored the events that occurred after the unveiling of South African businesswoman Shaun ‘MaMkhize’ Mkhize’s until recently to warrant urgency, marking an official disagreement at least in court.

It follows in Simelane’s urgent application in Eswatini High Court of an alleged contract breach of sole directorship as per the ‘Management Agreement’ where he cites the chairman of the board of patrons of Mbabane Highlanders, Mkhize, Mbabane Highlanders Football Club, Premier League of Eswatini (PLE) and the Eswatini Football Association (EFA) as the five respondents that he is vehemently opposed. 

MaMkhize and others said that the urgency is self-created as MaMkhize’s unveiling as the new president of Mbabane Highlanders Football Club occurred on July, 12, 2025 at Ocean Cuisine in Manzini and was publicised in the local media and social media platforms.

The respondents object. They say Simelane waited after almost a month to bring the present application despite being aware of the status change of the position of the president of Mbabane Highlanders F.C.

Simelane’s termination happened on June 12, 2025, it was said.

“The Applicant has failed to outline reasons to justify his failure to bring the application timeously despite having been aware of the termination on the 12th June, 2025 about two months ago. With respect, this amounts to litigation by ambush and the urgency in this matter is self-created,” the papers say. 

It is further said that the attitude of remaining silent for over a period of two months and “then engaging an accelerated gear in the hope to jump a queue and have a matter heard on an urgent basis,” is ambush, urging the court to dismiss the matter with costs.

“The doors to urgency are not supposed to be abused by litigants and must remain pure for real and urgent matters.

“It will be the submission of the Respondents that litigating by ambush is frowned upon by the Courts of the land and ought not to be entertained in the present matter. The Application stands to be dismissed with an appropriate order as to costs,” the documents read. 

‘MaMkhize’ and others also said that ‘Rubber’s contract is flawed from the beginning.
