MBABANE – A 22-year-old man has been sentenced by the High Court to three years imprisonment for inserting a log into a five-year-old minor’s buttocks, defined as “unlawful sexual act without consent.”
The man whose identity is concealed was found guilty under Sections 3(1) and 3(3) read together with Section 30(9)(a) and (b) of the Sexual Offences and Domestic Violence Act 15/2018.
He was apprehended on September 11, 2022, in the Manzini Region, Eswatini. The minor’s mother testified that she took the minor for a medical check up after receiving the report from him.
Medical evidence also corroborated the complaint with the doctor confirming that the injuries were consistent with the insertion of a blunt object.
The accused pleaded not guilty. However, the court found his testimony unbelievable, citing inconsistencies and lack of truthfulness.
The court emphasized that the accused showed no remorse and failed to take responsibility for his actions.
The accused’s lawyer argued for a non-custodial sentence, but the court deemed a custodial sentence necessary to prevent similar offenses and to achieve justice for the victim. Samson has the option to appeal his sentence.
