East London, South Africa – Nigerian televangelist Timothy Omotoso has been released by the East London Magistrates Court after a procedural error by South Africa’s Department of Home Affairs. His release followed an arrest on Saturday in the East London CBD for alleged contravention of the Immigration Act.
Authorities had accused Omotoso of violating immigration laws, but failed to present him in court within the required 48-hour window, which expired at 7am on Monday. He only appeared before the court at 2pm that afternoon, leading to his immediate release on Tuesday.
The Department of Home Affairs confirmed the release and said it would review its position once it receives the written court judgment. Omotoso’s legal team is also challenging a deportation order issued by the department, arguing that any arrest should be suspended until the outcome of the review.
Meanwhile, the National Prosecuting Authority is appealing a ruling by the Eastern Cape Division of the High Court in Gqeberha. In April, Judge Irma Schoeman acquitted Omotoso and two co-accused, ruling that the state had not proven its case beyond reasonable doubt. The trio had faced over 30 charges, including rape and human trafficking.
Outside the court, news of Omotoso’s release sparked a commotion among supporters and detractors, leading to a brief scuffle before public order police restored calm.
