Man (21)faces three counts over alleged unlawful recordings

Manzini- A 21-year-old Fairview man has appeared before the Manzini Magistrates Court on Monday facing three counts of contravening the Sexual Offences and Domestic Violence Act after he was allegedly found to have unlawfully recorded women while they were engaged in private acts without their consent.

The accused, **Sambulo Seedwell Msibi of Fairview Empholi under Chief Nkosini, faces three charges in terms of Section 33(1)(a)(b)(ii) of the Sexual Offences and Domestic Violence Act No.15 of 2018.

According to the charge sheet before court, the alleged offences occurred in July 2026 in the Manzini District, involving three separate complainants.

In the first count, the State alleges that on July 24, 2026, at or near Mpholi, Msibi unlawfully observed or visually recorded *Nokwanda Dlamini* (17), while she was engaged in a private act without her consent, despite her having a reasonable expectation of privacy.

The second count relates to an alleged incident that same day at Fairview Malahleni, where Msibi is accused of unlawfully recording *Tracy Magagula* while she was engaged in a private act without her consent.

The third charge stems from an alleged incident on July 21, 2026, also at Fairview Malahleni, where he is accused of recording *Nokuthula Mdziniso* during a private act without her consent.

The offences relate to Section 33 of the Sexual Offences and Domestic Violence Act, which deals with unlawful observation or visual recording of a person engaging in a private act in circumstances where they reasonably expect privacy.

The accused appeared before the Manzini Magistrates Court, where the charges were formally presented. The matter was postponed to August 4, 2026, for further proceedings.
