Witness cops no show at MP Bacede’s trial

Mbabane: Cops that are key witnesses in Hosea Member of Parliament Mduduzi ‘Bacede’ Mabuza’s case could not show up for the trial that was set to proceed on Monday and that was one of the reasons that had the case postponed to November 24.

Mabuza appeared before Acting Magistrate Simo Simelane at Mbabane Magistrate court, on Monday facing cases of obstruction of Justice and assault among others. Mabuza was arrested on August 5, 2020 and was released on bail on the next day. After being released on bail, Mabuza was set to return back to court on August 24. Mabuza was represented by his attorney Mduduzi ‘Tsotsi’ Mabila.

Upon arrival in court, Senior Crown Council Chris Sibandze revealed that Ayanda Matsenjwa who was the prosecutor when the case first appeared in court could not proceed with the case anymore hence Sibandze will take over as Prosecutor for the case. Sibandze requested that the case be transferred to Senior Magistrate Sifiso Vilakati and it eventually moved to Senior Magistrate’s court.

Before the case was eventually moved to Senior Magistrate, Lawyer Mduduzi Tsotsi Mabila raised concerns on why the matter is being transferred to Senior Magistrate because this are cases that the court was capable of dealing with. Mabila said by so transferring the case, it will drag and that cost his client and it disturb his client’s participation and concentration at Parliament as Mabuza is a member of Parliament representing Hosea constituency. Mabila said his client cannot fully debate matters freely in Parliament as he is having a pending case.

Magistrate Simelane then transferred the case to Senior Magistrate Sifiso Vilakati. The case was presented before Vilakati and after a brief hearing it was postponed to a later date of November 24, 2020.
