Mbabane – A 35-year-old man accused of theft by false pretenses has been granted E50 000 bail by the Mbabane Magistrates Court after he allegedly failed to fulfil a promise he made to the complainant.
The accused, Thanduxolo Fakudze, appeared before Principal Magistrate Fikile Nhlabatsi to answer to charges of defrauding Lungelo Fakudze. According to the charge sheet, in January 2024, at Mbabane, Thanduxolo promised to supply Lungelo with a VW Polo and and through this misrepresentation, obtained E108 500 payment.
The accused was represented by attorney Noncedo Ndlangamandla who told the court that her client wished to apply for bail whereby the prosecution applied for his remand into custody before not opposing his bail application.
She submitted that the accused has three minor children who depend on him and that he is self-employed, dealing in the buying and selling of motor vehicles. She added that Fakudze has already begun reimbursing the complainant.
“We believe that by the time trial starts, he will have fully reimbursed the complainant,” she told the court.
Magistrate Nhlabatsi granted the accused E50 000 bail in terms of Section 102 of the Criminal Procedure and Evidence Act, under standard bail conditions. These include, not committing the same offence while out on bail, not interfering with Crown witnesses especially the complainant, with the intention of influencing the withdrawal of the matter and he is expected to attend all remands and trial proceedings whenever the court orders him to do so.
Fakudze is expected to reappear on December 19, pending trial set for April 16, 2026.
