Mbabane – A 35-year-old man from Sandla appeared before the Mbabane Magistrates Court charged with contravening Section 77 (1) (a) of the Sexual Offences and Domestic Violence Act 15 of 2018 after he assaulted his girlfriend following a disagreement over sexual intimacy.
According to court records, the incident occurred on November 6, 2025, at Sandla. The accused, who was in a romantic relationship with the complainant, assaulted her with fists and kicks all over her body after the two got into an argument that turned violent.
When asked by the court to explain his actions, the accused said that he and the complainant had a misunderstanding that night. He told the court that they usually slept without clothes, but on that particular evening, he chose to wear his pyjamas as he was not in the mood for sexual intercourse. This reportedly angered the complainant, leading to a heated confrontation that resulted in the assault.
The accused apologized for his behaviour, saying he regretted his actions and did not intend to harm his partner. He further told the court that he loved the complainant and that the altercation arose out of misunderstanding.
After considering his plea and mitigation, the court found the accused guilty and sentenced him to pay a fine of E2,000, failing which he would serve one year in imprisonment.
The presiding magistrate emphasised the seriousness of domestic violence cases and reminded the accused that no amount of misunderstanding or emotional dispute justifies physical assault.
