Mbabane – A 26-year-old man of Ntondozi appeared before the Mbabane Magistrates’ Court on Monday for allegedly having unlawful sexual intercourse with a 14-year-old minor.
He’s been charged with multiple counts contravening section 77 of the Sexual Offences and Domestic Violence Act of 2018 related to rape.
Court documents state that the accused committed the offences between June and October 2025, during which time the accused further maintained the sexual relationship with the minor. The charges include contraventions of Sections 3(1), 3(2), 3(3)(c), and 3(6)(e), read together with Section 3(9)(b) of the Act.
The second charge alleges that the accused contravened Section 42(2) of the Act by unlawfully taking the girl from her custodian with the intention of engaging in sexual activity.
The third count alleges a breach of Section 37(1) as read with Section 37(5) for maintaining a sexual relationship with the minor over the specified period.
Aggravating factors in this case were noted, including that the accused allegedly did not use protection during the acts, placing the victim at risk of sexually transmitted infections, including HIV/AIDS.
The magistrate scheduled a subsequent hearing to allow both prosecution and defence to present their arguments and review further evidence.
The matter remains before the court, with legal proceedings ongoing; the accused is to be remanded into custody until 17 October pending trial on the 6th of November and should apply for bail at the High Court.
