MBABANE – Business Eswatini has withdrawn its court application against EswatiniMed Principal Officer Peter ‘Samora’ Simelane and former board chairperson Sammy Dlamini, marking a dramatic turn in the ongoing leadership dispute at the medical aid fund.
The application, filed under case number 633/2025, was linked to a March 25 interim order granted by Judge Ticheme Dlamini. That order barred Simelane and Dlamini from convening shareholder meetings or interfering with investigations into the Fund’s affairs without approval from the full board or shareholders.
Business Eswatini had taken the matter to court, accusing the two officials of bypassing internal governance procedures by calling an Annual General Meeting (AGM) without proper authorisation. The federation cited violations of the Companies Act of 2009 and EswatiniMed’s Memorandum of Incorporation.
The court order also restrained Simelane from threatening members of the interim board after allegations surfaced of intimidation, including one sworn statement that claimed he made death threats against a board member.
Despite the court’s directive, Simelane went on to hold the contested AGM. Business Eswatini responded by filing for contempt of court, accusing him of disobeying the order.
However, a formal notice of withdrawal was recently filed, ending the legal action against both Simelane and Dlamini. The reasons for the withdrawal have not been made public, and it remains unclear whether the parties reached an out-of-court settlement or if other developments influenced the decision.
