Mbabane – A 24-year-old man has been remanded in custody until December 5 as his rape case encounters unexpected complications. The case, which had already raised concerns, took a dramatic turn when the docket reportedly went missing, further complicating the proceedings.
During a recent court session, the accused, who had been arrested while attending church, expressed confusion over the situation. He told the court that a visitor, who also happens to be the complainant, informed him during her visit in custody that he was not the person responsible for the alleged offence. Instead, the complainant named another man as the perpetrator.

This revelation has left the accused, named Dlamini, unsure about how to proceed with his defence. The court, however, voiced concerns over Dlamini’s mental health, prompting an order for a psychiatric evaluation to assess his fitness to stand trial. A psychiatric assessment will be conducted at a designated mental health facility to determine his condition.
Principal Magistrate noted that the missing docket and conflicting statements have raised serious doubts about the case, affecting the pace of justice. The court further advised Dlamini to apply for bail through a letter to the High Court.
In a related case, Vusumuzi Kunene, who has been in custody since 2014, was also remanded until December 5. Kunene is awaiting a psychiatric evaluation to determine if he is mentally fit to stand trial. The court has yet to receive the necessary mental health report, which is crucial in deciding whether his trial can proceed.
The Principal Magistrate emphasized the importance of psychiatric assessments in ensuring fair treatment for individuals facing criminal charges, noting that such evaluations are critical for conducting trials in line with legal and ethical standards.
