Manzini – The Ndimande brothers who are accused of killing Hip-hop artist AkA and his friend Tibz have appointed senior counsel Advocate Tsotsi Mabila and South African Advocate J Howes. Their Extradition Application hearing was supposed to be staged today at the magistrates court but was again postponed to April 9,2024. The applicant’s representative Sivesonkhe Ngwenya applied for the postponement of the Extradition Application hearing.
Making his submission Ngwenya stated that his office was only furnished with the Extradition Application documents on Monday,March18,2024 this his office needs to go through the papers with precision.
“ The document is a very bulk document with about 254 pages and it needs time for us to go through it with precision “ Ngwenya said. The postponement of the hearing will give the appointed counsel much time to familiarise themselves with the papers.
The defendant through Prosecutor Macebo Nxumalo stated before the court that he was ready to argue the matter. “ “The country is taking this matter seriously and urgently thus we are ready to argue it today” Nxumalo stated
He continued to state that with all the aforementioned facts,the defendant is willing to allow the applicant to postpone the matter to the aforementioned date. The presiding principal Judge Khumalo agreed to the moved application. The provisional detention of the gadgets remains untill the return of the case to court.
Another Extradition Application was for the murder accused suspect Mfanawenkhosi Magagula which was also postponed to the same date
Principal Khumalo also highlighted that the suspects will remain in their usual custody and their remand hearing and execution will be done in their custody where the court will handle the process in the remand centre. He stated that their return to court for the remand hearing would cost the state while the proposed hearing will be cost effective.
